The domain name www.advancedhairstudioindia.com (hereinafter referred to as “Website”) is owned and managed by Advanced Hair Studio Private Limited (hereinafter referred to as “AHS”). The term “We”, “Us”, “Our” shall mean Advanced Hair Studio Private Limited.

The access of the Website by User is governed by the following terms and conditions (hereinafter referred to as “Terms of Use”). Whenever user uses any of the services provided by AHS through the Website, user will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use. AHS reserves the right, at our sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time without any prior written notice. The user shall be solely responsible for reviewing these Terms of Service each time it visits the Website.  

REGISTRATION

The user shall Register/Book the appointment in the Website by giving true and correct information about him/her which in turn shall help us to provide the desired product/service/assistance. AHS allows the User to surf the Website without registering on the Website.

The user is responsible for maintaining the confidentiality of the account, for restricting access to the account from any devices and accepts responsibility for all activities that occur under user’s account. The Site shall not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with, failure to comply with this section.  

ELIGIBILITY

The services are not available to persons under the age of 18 or to anyone previously suspended or removed from the services by AHS. The user shall represent and warrant to have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement. The user shall not impersonate any person or entity, or falsely state or otherwise misrepresent identity, age or affiliation with any person or entity.  

PERMITTED USE

The user agrees to visit, view and to retain a copy of pages on this Site for your own personal use, and shall not duplicate, download, publish, modify or otherwise distribute the material on this Site for any purpose other than for personal use, unless otherwise specifically authorized by AHS to do so. The content and software on this Site is the property of AHS. Further no user shall make any negative, denigrating or defamatory statement(s) or comment(s) about AHS or the brand name or domain name in any conduct or action that might tarnish the image or reputation of AHS. The cardholder must retain a copy of transaction records and merchant policies and rules.  

INTELLECTUAL PROPERTY RIGHTS

All those Intellectual Property rights arising as a result of domain names, internet or any other rights available under applicable law shall vest in the domain of AHS as the owner of such domain name. The Parties hereto agree and confirm that no part of any Intellectual Property rights shall be transferred in the name of user and shall also be in the absolute ownership, possession and control of its licensors, as the case may be.  

ARBITRATION OF DISPUTES         

In case of any dispute, controversy or claim arising between AHS and the user in relation to the use of the Website (in any manner), the arbitration shall be conducted in accordance with the provisions of the Indian Arbitration & Conciliation Act, 1996. AHS and the user shall either mutual appoint a sole arbitrator or the Arbitral Tribunal shall comprise of three arbitrators, one appointed by each of the Parties and a third one shall be elected by the party appointed arbitrators, as may be agreed by both the parties. The language of Arbitration shall be English. The arbitration shall be final and binding on the Parties.  

APPLICABLE LAW AND JURISDICTION

Except as otherwise agreed by the parties or as described in the Arbitration section above, any claim or dispute shall be governed by the laws of India, without giving effect to any principles of conflicts of law.
